Employment Assistance Services Agreement

Limited Liability Partnership BCC-HUB, BIN________________, hereinafter referred to as the "Contractor", represented by the General Director _________________, acting on the basis of the Charter, provides any capable individual who has reached the age of 18, hereinafter referred to as the "Applicant", with services to assist in employment by providing the Contractor's website.

1. Terms and Definitions


1.1. Website --- the contents of Internet pages located on the Internet at the address of any of the domains managed by the Contractor, including, but not limited to http://www.bcchub.kz, which is used by the Job Seeker in accordance with this Agreement both directly at the corresponding addresses and through other sites and applications.

1.3. Job Seeker --- a visitor to the Site who visited the Site in order to search for a job, or who also uses the Site to search for a job, but without registering on the Site.

1.4. Database --- a collection of Job Seekers' CVs located on the Internet at the domain address http://bcchub.kz.

1.6. Resume --- a document containing the personal data of the Job Seeker, including information about the last name and first name, email address, education, description of places of work, as well as other data related to the job search.

1.8. Website User --- an individual using the website services available to him/her.


2. Subject of the Agreement


2.1. The Contractor undertakes to provide the opportunity to create responses to vacancies published on the website.

2.2. In accordance with the Law of the Republic of Kazakhstan dated May 21, 2013 No. 94-V "On personal data and their protection", the Applicant hereby gives his/her consent to the collection and processing of personal data for the purposes specified in clause 2.3 of this Agreement, and expresses consent for the Contractor to perform the following actions with all personal data specified by the Applicant, including in the relevant Resume: distribution (only in relation to the Resume or data from the Resume), collection, systematization, accumulation, storage, use, provision, access, blocking, destruction, processing.

2.3. The purpose of processing the personal data of the Job Seeker includes the following:

2.3.2. The possibility of employment or other types of employment with Clients, as well as conducting a preliminary interview for the purpose of employment or other types of employment with Clients, the provision of services/performance of work by the Job Seeker to the Client on the basis of a civil law contract;

2.3.3. Sending notifications, requests and information regarding the use of the services of the Site, contacting in any other way for the execution of this Agreement, processing requests and appeals from the Job Seeker;

2.3.4. Improving the quality of the services of the Site, the ease of use, developing new services of the Site;

2.3.5. Targeting advertising materials;

2.3.6. Sending any information messages, including advertising;

2.3.7. Conducting statistical and other research;

2.3.8. Fulfilment by the Contractor of its obligations under this Agreement.

2.5. Nothing in this agreement shall be understood as establishing between the Contractor and the Jobseeker an agency relationship, a partnership relationship, a joint venture relationship, a personal employment relationship, or any other relationship not expressly provided for in this agreement.

2.6. When the Jobseeker responds to a particular vacancy of the employer of this vacancy, questions may be received, the results of the answers to which remain with the employer and are not communicated to the Jobseeker, or the employer may offer the Jobseeker to take a test from a potential employer on the Site. At the same time, no questions from the employer and the Jobseeker's answers to them may be understood as the only criterion for hiring. The Jobseeker's answers to the employer's questions are confidential.

2.7. By concluding this Agreement, the Jobseeker expresses to the Contractor his consent to the provision by the Contractor of an order for the processing of the personal data of the Jobseeker, posted in the form on the Site, to the Personnel Management Center of CenterCredit Bank.


3. Obligations of the Contractor


3.1. The Contractor undertakes to:

3.1.1. provide the Job Seeker with the opportunity to send a resume on the website bcchub.kz;

3.2. The Contractor has the right, based on the contact information specified in the Resume, to provide the opportunity to send informational messages to the Job Seeker related to his possible subsequent employment with the employer

3.12. The Contractor has the right, in order to periodically improve the quality and develop the functionality of the Site, as well as to study potential demand, to conduct experiments, within the framework of which it is possible to replace the names of the components of the Site and the Contractor's application (for example, the names of buttons, sections, etc.). Such a change of names does not entail a change in the terms of this Agreement.


4. Obligations of the Job Seeker


4.1. The Job Seeker undertakes not to commit the following actions:

4.1.1. By any means, through the Site, post, distribute, save, download and/or destroy materials (information) in violation of the legislation of the Republic of Kazakhstan and international legislation.

4.1.2. Post and/or transmit through the Site information in the form of text, images, sound or program code that may be illegal, advertising, threatening, offensive, slanderous, knowingly false, rude, obscene, harm other visitors to the Site, violate their rights and legitimate interests.

4.1.3. Implement executable code on the user's side (client scripts: java-script, visual basic-script, etc.), any implemented objects (java-applets, flash, etc.), use frame and iframe, cascading style sheets that override those used on the Site, as well as html code that violates the original design of the page.

4.1.4. Introduce yourself under a false name or on behalf of a false person (an individual) --- an employee of the Contractor. Mislead users and the Site administration regarding your identification in any other way.

4.1.5. Post knowingly false information.

4.1.6. Destroy and/or modify any materials on the Site that the Applicant is not the author of.

4.1.7. Use information about telephone numbers, postal addresses, e-mail addresses for purposes other than the subject of the Site (questions of recruitment, selection of candidates).

4.1.8. Post telephone numbers(s) that the Applicant does not have the right to use, or the number belongs to legal entities.

4.2. The Applicant undertakes to regularly familiarize himself with the contents of this Agreement in order to promptly familiarize himself with its amendments.


5. Information Security of the Site


By using the Site, the Applicant undertakes not to violate or attempt to violate the information security of the Site, which includes:

5.1. attempts to interfere with the use of the Site by users, which includes the distribution of computer viruses, data corruption, constant sending of repetitive information, forwarding e-mail through the site server, simultaneous sending of a large number of e-mails and/or requests to the Site with the aim of deliberately putting the site server out of order, and similar actions that go beyond the normal intended use of the Site and may intentionally or inadvertently lead to failures in its operation;

5.4. sending users of the Site materials to which they have not given their consent, "spam", any letters and advertisements without the permission of the Contractor;

5.5. imitation and/or forgery of any TCP/IP packet header or any part of the header in any e-mail or material posted on the Site;

5.6. use or attempts to use any software or procedure for navigation or search on the Site, except for the search engine built into the Site and traditional and public browsers (Microsoft Explorer, Mozilla Firefox and other similar).

5.7. use of software that simulates the work of the Applicant on the Site, including in the Contractor's application.

5.8. Violation by the Applicant of the security of the system or computer network or attempts to violate it entails civil and criminal liability. The Contractor will investigate all cases of possible security breaches or attempts to breach them by all users of the Site in cooperation with law enforcement agencies in order to prevent such malicious activity.

8. Use of site materials


8.1. Each user of the Site, Job Seeker or representative of the Client of the Site is responsible for the information posted on his behalf and the consequences of such posting.

8.2. The use of Job Seekers' Resumes is unacceptable for any purposes other than those relevant to the subject matter of the Site (job search, employee search).

8.3. If the Client of the Site saves the Job Seeker's Resume in his own database outside the Site, then the Client of the Site shall be responsible for this within the framework of the Law of the Republic of Kazakhstan dated May 21, 2013 No. 94-V "On personal data and their protection", as the operator of personal data.

8.4. It is prohibited to use software (scripts, robots) to read or collect information (data) from the Site.

8.5. The logo, name, design elements, layout and general appearance of the Site are the intellectual property of the Contractor and their use without the express consent of the Contractor is prohibited.


9. Cookies


9.1. The Site software may transfer Cookies or data included in Cookies to the Applicant's software, just as the Applicant's software may transfer Cookies or data included in Cookies to the Site.

9.2. The Contractor has the right to use Cookies in any way to identify the Applicant, as well as for any other purposes, including providing personalized services and services of the Site, advertising targeting, conducting research and other purposes.

9.3. The content, structure and any other characteristics of Cookies are determined by the Contractor at its own discretion.


10. Law applicable to relations between the Parties and dispute resolution


10.1. This Agreement, as well as the relations between the Applicant and the Contractor, including those not regulated by this Agreement, shall be regulated in accordance with the current legislation of the Republic of Kazakhstan. 11.2.

All disputes between the Parties under this Agreement shall be resolved through correspondence and negotiations using the mandatory pre-trial claim procedure for dispute resolution. The response period to a claim shall be 30 days from the date of receipt of the claim by the Party. If a Party fails to respond to a claim within the specified period, the Party that sent the claim shall have the right to go to court. All claims addressed to the Contractor must be sent to the address of the Contractor's location. If it is impossible to resolve disputes through negotiations or in a claim procedure, they must be resolved in court at the place of state registration of the Contractor in the manner prescribed by the current procedural legislation of the Republic of Kazakhstan.


12. Effectiveness of this Agreement, Amendments


12.1. This Agreement shall be effective from the moment of its acceptance by the Applicant.

12.2. The Applicant, by concluding this Agreement, represents and warrants that he/she has reached the age at which the Applicant is permitted to conclude this Agreement by the current legislation of the Republic of Kazakhstan, and the Applicant has the necessary legal capacity and capacity to conclude this Agreement.

12.3. The Contractor has the right, at its own discretion and without prior approval from the Applicant, to make changes to this Agreement. In such a case, the changes and additions shall come into force from the moment of their publication on the Website.

12.4. Use of the Site by the Applicant (as well as the exercise by the Applicant of the rights and obligations established by this Agreement) after any changes to this Agreement means the Applicant's consent to such changes and/or additions.

12.5. If the Job Seeker does not agree to use the Site after the Contractor makes changes to this Agreement and/or to comply with this Agreement after the changes, the Job Seeker undertakes to stop using the Site and has the right to terminate this Agreement by sending a corresponding notice to the Contractor.

12.6. The Contractor has the right at any time, including in the event of a violation by the Job Seeker of the terms of this Agreement, to terminate this Agreement unilaterally without any prior notice to the Job Seeker about this and any compensation in connection with this to the Job Seeker. In the event of termination of this Agreement, the Contractor shall delete the Job Seeker's Account Data, the Resume posted by the Job Seeker on the Site, and other materials and information.
